SERVICE AGREEMENT TERMS AND CONDITIONS
This Service Agreement (hereinafter referred to as “Agreement”) is entered into by and between The Organizing Experts, an unincorporated business owned by Kammie Lisenby and operating in the State of Washington (hereinafter “THE ORGANIZING EXPERTS”), and the undersigned client (hereinafter “Client”). Upon execution of this Agreement, THE ORGANIZING EXPERTS agrees to provide home organizing, business organizing, and/or concierge services under the terms set forth below:
1. TERM AND TERMINATION
This Agreement shall terminate upon completion of the requested services, or upon mutual written agreement by both parties. Either party may terminate this Agreement with at least 48 hours' written notice prior to a scheduled session. If terminated, THE ORGANIZING EXPERTS shall be compensated for all services rendered up to the effective date of termination.
2. CHANGES TO SERVICES
Client may request modifications or additions to the services in writing. Approval of such changes is at the sole discretion of THE ORGANIZING EXPERTS and may incur additional fees. Any approved modifications shall be appended to this Agreement and governed by its terms.
3. PERFORMANCE OF SERVICES
THE ORGANIZING EXPERTS shall exercise independent judgment in performing services and will supervise the methods by which work is carried out. Client shall retain the right to reasonably approve results but may not control the manner or means of performance.
4. ORGANIZER STATUS
THE ORGANIZING EXPERTS and any assigned organizer shall be treated as independent contractors. Nothing herein shall be construed to create an employment relationship. Client shall not withhold taxes or make employment-related deductions.
5. NO WARRANTY
THE ORGANIZING EXPERTS provides no warranty, express or implied, for services performed. All services are offered “as is.”
6. FEES AND PAYMENT
Unless otherwise stated in writing, services are billed at $65/hour. Payment is due at the time of service via check, cash, or credit card. Supplies, tolls, and parking fees are billed separately. A flat $10 toll fee applies per session, if applicable.
Late payments are subject to a $25/day late fee. Checks returned due to insufficient funds will incur a processing fee plus all applicable bank and state NSF charges. Balances unpaid beyond 30 days are subject to interest at 1.5% per month (18% annually). All collection and legal costs, including attorney’s fees, shall be the Client’s responsibility.
7. CANCELLATIONS AND RESCHEDULING
Client must provide at least 48 hours' notice to cancel or reschedule any organizing session.
Cancellations made with less than 48 hours’ notice will be charged 50% of the scheduled session fee.
Rescheduling with less than 48 hours’ notice will incur a non-refundable $95 reschedule fee, unless waived in writing by THE ORGANIZING EXPERTS.
This fee is intended to compensate for time lost and administrative effort. Client expressly agrees that this fee is enforceable without court action, and any costs incurred by THE ORGANIZING EXPERTS in collecting this fee shall be the responsibility of the Client, including but not limited to administrative time, collection costs, and attorney fees if necessary.
Client agrees and acknowledges that their credit card on file will be charged unless other arrangements are made in writing at the time of cancellation or rescheduling.
8. REIMBURSEMENT FOR EXPENSES
Client agrees to reimburse all out-of-pocket costs incurred, including supplies, parking, tolls, or other related expenses. If an organizer personally purchases supplies, receipts will be provided and reimbursement is due upon presentation. A 3% fee applies to reimbursements made via credit card.
9. REALISTIC EXPECTATIONS
Organizing is an elective lifestyle service. While improvements are expected, specific outcomes may vary. No results are guaranteed. THE ORGANIZING EXPERTS is not liable for lost, damaged, or misplaced items. Following the post-session “Next Steps” plan is highly recommended to maintain results.
10. LIMITATION OF DAMAGES
THE ORGANIZING EXPERTS' liability is limited to direct, measurable damages. Under no circumstances shall THE ORGANIZING EXPERTS be liable for indirect, incidental, or consequential damages, lost profits, or loss of data.
11. LIABILITY CAP
Total liability under this Agreement shall not exceed the total amount paid by Client for services rendered under this Agreement.
12. STATUTE OF LIMITATIONS
No legal action may be brought by either party more than one (1) year after the cause of action arises.
13. CONFIDENTIALITY
All personal and professional information obtained by THE ORGANIZING EXPERTS shall be treated as strictly confidential unless explicitly released by the Client in writing.
14. PHOTOGRAPHS, VIDEO & TESTIMONIALS
By signing this Agreement, Client authorizes THE ORGANIZING EXPERTS to take and use photos or videos for training, documentation, or marketing, unless otherwise requested in writing.
15. ORGANIZING TIMES
Start and end times are approximate. A 30-minute break is included during full-day (6+ hour) sessions. Services may include donation drop-offs, recycling runs, and product shopping during the scheduled time.
16. ASSIGNED ORGANIZER
Requests for specific organizers will be honored when possible. In the case of illness, leave, or departure, a substitute professional organizer will be assigned.
17. NON-SOLICITATION
Client agrees not to solicit or hire any THE ORGANIZING EXPERTS employees or contractors, directly or indirectly, for a period of one year following the end of this Agreement.
18. SERVICE GUARANTEE
Client must notify THE ORGANIZING EXPERTS within 48 hours of any dissatisfaction. If reasonable and directly related to quality, THE ORGANIZING EXPERTS will return and remedy the issue free of charge. No refunds or remedies will be issued after 48 hours or if Client chooses to correct the issue independently.
19. DONATION & ITEM DISPOSAL
Client authorizes THE ORGANIZING EXPERTS to remove one carload of donation or disposal items per session unless otherwise agreed. Once items are relinquished, they become the property of THE ORGANIZING EXPERTS and may be donated, sold, recycled, or discarded at their discretion.
20. SEVERABILITY
If any part of this Agreement is found to be invalid or unenforceable, the remainder shall continue in full force and effect.
21. VENUE AND JURISDICTION
All disputes shall be resolved in King County, Washington, and Washington State law shall govern.
22. EXPENSES OF ENFORCEMENT
Client agrees to pay all expenses, including attorney fees, incurred by THE ORGANIZING EXPERTS in enforcing any part of this Agreement, including the collection of unpaid service or rescheduling fees.

I certify that I am at least 18 years of age and competent to enter into this agreement. I confirm that any questions or concerns have been addressed to my satisfaction, and I agree to the terms outlined herein. I understand that a copy of this Agreement is available to me upon request.
